AGF Explains Delay in Releasing Inmates Pardoned by President Tinubu
AGF Lateef Fagbemi explains why inmates pardoned by President Tinubu remain in custody, citing ongoing legal and procedural reviews to ensure due process.
The Attorney-General of the Federation (AGF) and Minister of Justice, Lateef Fagbemi, SAN, on Thursday explained why none of the inmates recently granted presidential pardon by President Bola Tinubu have been released from correctional custody.
According to the minister, although the Council of State approved the exercise of the President’s prerogative of mercy, the process remains incomplete and is still under administrative review.
In a statement personally signed by him and made available to journalists, Fagbemi said the exercise is still undergoing final verification to ensure full compliance with legal and procedural requirements before any release is effected.
“The Office of the Attorney-General of the Federation and Minister of Justice wishes to clarify that no inmate approved for clemency under the recent exercise of the President’s power of prerogative of mercy has been released from custody,” Fagbemi said.
“The process remains at the final administrative stage, which includes a standard review to ensure that all names and recommendations fully comply with established legal and procedural requirements before any instrument of release is issued.”
The minister explained that after the Council of State’s approval, the final stage involves the issuance of official instruments for the implementation of each decision — a process that allows for one last review “for remedial purposes, if any,” before forwarding the documents to the Controller-General of Corrections for action.
“This verification process is part of the standard protocol and reflects the government’s commitment to transparency and due diligence,” he added.
Fagbemi said the government’s cautious approach demonstrates its respect for the rule of law, stressing that “there is no delay,” but rather “a lawful process aimed at ensuring that only those duly qualified benefit from the President’s mercy.”
“The Honourable Attorney-General of the Federation and Minister of Justice appreciates the public’s vigilance and constructive feedback, which continue to strengthen institutional integrity,” the statement read.
“Public engagement is always welcome, as it demonstrates that Nigerians care deeply about justice and good governance. The rule of law does not rush; it ensures fairness.”
It will be recalled that 175 convicts and ex-convicts were recently granted presidential clemency by President Tinubu, among them individuals convicted of serious offences including drug trafficking, terrorism, and murder.
The development generated mixed reactions across the country, with critics questioning the inclusion of some beneficiaries they said did not deserve such leniency.
